On PM 3/12/2009, China Mobile featured Dr. John Chiang of USITO as the key speaker for its monthly "Infinity Forum" event. Bill Huang, President of China Mobile Research Institute moderated the event, which attracted a large audience from the government and industry CMCC Report. Our outreach programs in the week also include a roundtable with Liu Hui, head of Govt. Procurement Institute of the Univ. of Int'l Relations (UIR). Both sides discussed potential coop. in the GP field.

MIIT Updates Regulation for Telecom Services

On March 5, the Ministry of Industry and Information Technology (MIIT) issued a circular, which states from 4/10/2009 the new Telecommunications Service Operation License Management Rules will come into effect. The new regulation will replace the old version released on 12/26/2001.

The new version contains 9 chapters and 49 articles; whereas the old one had 8 chapters and 40 articles. The fifth chapter of the new version contains six more articles than the previous one, most noteworthy among which lies in that "State-owned equity in all basic telecom service companies should not be lower than 51% of the total". In the last but one chapter ¡°Fining Rule¡±, it defines more infringing items and specifies harsher punishment, such as there will be three-year freeze on license application for companies violating the rules or obtaining licenses through inappropriate means. USITO Notes: By comparing the two versions, we found that the new one has absorbed a number of rules formulated by MIIT, which were released separately by the ministry in the recent years. For instance, a major change is on the amount of the registered capital requirements: capital for basic telecom business licenses is lowered from RMB 200 million to RMB 100 million (for regional); from RMB 2 billion to RMB 1 billion (for nationwide). This rule was released in September 2008 in another regulation of MIIT, the Management Methods for Foreign Invested Telecom Enterprises. The mandate for 51% minimum SOE equity in basic telecom companies should not be a surprise: the old version also stated in its Appendix II that SOE equities in those firms should "conform with related laws and regulations", which in essense should be same requirement as that of the new one. Despite these changes, most other terms remains the same, except some wording adjustment.

At the current stage it is unrealistic for rules like this one to have disruptive changes. China has a number of regulations that oversee the telecommunications sector, and regular updates, usually at 5-10 year intervals, are not uncommon but slight. The long-waited Telecom Law is said to be in the final round of senior discussion, with several contravercial terms hard to receive concencus between different interest groups.


Translation of China WEEE Regulation

As covered in the last edition of USITO newsletter, the Chinese government has officially released the "Regulation for the Management of the Recycling and Disposal of Waste Electrical and Electronic Products" ("China WEEE"), which reflects the top-level Chinese government attention toward the construction of a national regulatory program aimed at take-back and recycling of electrical and electronic products. We noted in the newsletter that we would welcome feedbacks from our member companies on this issue. USITO Notes: After consulting a few member company reps, we got some further readout points for the regulation. First of all, the regulation has not yet defined a specific product list applicable under the new rules. The list looks closely related to the China RoHS, as the products to be covered include all those defined under China RoHS. So the industry has a concern that the clear definition of the applicable products should be necessary. Experts say it is almost sure that the government will further release the ¡°Catalogue of Products¡± before the effective date January 1, 2011.

Under the new regulation, producers and importers are required to bear recycling obligations, like the donation to the special fund ¨C waste electrical and electronic equipment fund, and sellers are required to bear discarding location obligations. Experts say these obligations appear rather broad in the regulations, and there is a lack of clear interpretation for the additional/follow-up obligations.

Sources said the new rule would add the manufacturers' production cost by 10% or even more, so in this economic downturn period the enforcement is obviously a problem. Though there are nearly two years grace period, it is doubtful whether the Chinese companies will observe the rules.

China Mobile Launches New Bidding

A TD vendor told the media that China Mobile has issued an RFP for supply of wireless network equipment for phase 3. According to the RFP, the TD wireless network equipment to be procured is for 200 cities, covering 39,000 wireless base stations, 1.6 times the size of project phase 2. Chinese Text

Telecom Carriers to Invest Heavily in Zhejiang

On March 7, the Provincial Government of Zhejiang signed a framework agreement on strategic cooperation with three telecom carriers respectively. According to these deals, the telecom carriers will invest totally RMB 100b in Zhejiang in the next 5 years, of which, China Mobile will invest RMB 50b, and the number is RMB20b for China Unicom and RMB 20-30b for China Telecom. Regulator Relaxes Grip on Mobile Charges

On March 10, MIIT Minister Li Yizhong said newly delivered mobile services must be based on one-way billing. Li made the remarks at the press conference for the 2nd Plenary Session of the 11th National People's Congress. Chinese Text

China , UK to Work on 4G R&D

Sources from Edinburgh University said that the Research Councils UK has approved a total of GBP 939,600 for the UK-China Science Bridges Awards program, to support R&D of 4G wireless communication system in the next three years. This is the first financial assitance granted by UK governemnt for the mobile communication project with Chinese agency involved. Chinese Text

Google Said to Renew Deal with China Mobile

Sources said Google has renewed the cooperation agreement with China Mobile, and that both sides will continue their cooperation on R&D of mobile search and Monternet. China Telecom Said to Buy 1.5m Data Cards

Sources said Skywing, China Telecom's handset arm, launched a centralized procurement of 1, 5m EVDO data cards last week. About 10 vendors has submitted their bids. Chinese Text

China Telecom Procures 1.2m 3G Handsets

China Telecom is said to have completed the centralized procurement of 1.2m 3G handset. Huawei and Samsung won the contracts for supplying handsets. The procured CDMA handsets support 3G for the first time. Chinese Text

China Mobile to Cut Cross-straits Roaming Rate

MIIT: Radio Licensing Rules to Take Effect in April

China Telecom signed a strategic cooperation agreement with Hisense in Beijing on March 12. Under the agreement, both sides will enter into strategic partnership in communication service, product and resources utilization. ZTE Ranks First in 3G Handset Patents

ZTE, China's top telecom vendor, said that it ranks first in owning handset patents and filing 3G handset patent applications, exceeding 1,000 cases. According to ZTE's IP Director, ZTE has secured all the handset core technologies except some core technologies of chip, and become one of the vendors capable of developing 3G , 3.5G , 5G , GSM, CDMA, PHS, and wireless network card prodcts. Second Round of Bidding Procedures to Be Launched for ¡°PC for Farmers¡± Program

The press release posted on the Ministry of Commerce website on March 11 said that the 51 st Executive Meeting of the State Council decided to increase efforts to enforce the ¡°Household Appliances for Farmers¡± program. Lenovo Charged with Failure to Pay Royalties

MPEG LA sued Lenovo in Germany and U.S., for failing to pay due royalties for use of digital video compression standard, which is now used industrywide. MPEG LA is a U.S. firm managing the patents in encoding and decoding technologies. Chinese Text

CNNIC Plans to Draft International Standard for Internet Keyword

CNNIC reached an intent of strategic cooperation with South Korea's NETPIA, aiming to accelerate the establishment of international standard for Internet keyword. This will weaken the dominance of English letters in the domain name field. CNNIC is the agency responsible for registration and management of Internet keywords, while NETPIA is the developer of Internet keywords in South Korea. Chinese Text

CNNIC: China Mobile to Deliver CN Damain Name Registration Service

News posted on the website of CNNIC said that China Mobile has received the certification of CNNIC and become another certified CN domain name registration service provider, following Alibaba, Sina and Baidu. Taobao.com May Enter American Market

According to a foreign media report, Ma Yun, the founder of Alibaba.com in China, may likely expand Taobao.com services to America, to compete with eBay and Paypal. This is a good news for vendors dissatisfied with eBay. Currently, Taobao.com controls 80& of the personal e-commerce market in China, exceeding the market share of eBay, its U.S.-based rival. On March 10, the Internet Society of China held the inauguration ceremony of the Network Creditability Promotion Alliance. Banker Calls for Third Party Payment Platform Licensing System

According to Ma Weihua, President of China Merchants Bank, a third party payment platform licensing system can facilitate the setting of the access threshold for the e-payment sector, compliant operation of the payment market, and steady development of E-commerce and security of the financial system. 4 Software Makers Receive International Certification

On March 10, 4 software enterprises in Xinjiang went through CMMI III certification and received the certificates. This marked the milestone for software makers in Xijiang, as the CMMI III certificate provided software makers direct access to international market. CMMI certification is a recognized pass for software markets to enter the international market, and also serves as a means of propelling software makers to make advances in R&D, production, service and management. Inspur Considers Overseas Acquisition

Inspur Group Chairman and CEO Sun Pishu said in an interview with the media that Inspur is considering the possibility of acquiring some firms in Europe and America. According to Sun, high performance server is of strategic importance to the information security, just like memory as to the electronics industry.
