SAC Seeks Input on Standards Involving Patent Measures

On March 7th, USITO and representatives of local and foreign trade organizations and companies attended a meeting co-organized by the Standardization Administration of China (SAC) and the China National Institute of Standardization (CNIS) to discuss comment submissions on the Regulatory Measures on National Standards Involving Patents (Measures). 

 

SAC has requested further input on eight key areas:

  • Scope of patent domain
  • Definition of essential patents and claims
  • Governmental role and responsibility in patent verification
  • Patent applicant's patent disclosure and accountability (patent disclosure based on personal or corporate knowledge?)
  • Definition of legal responsibility for patent disclosure
  • National standard project proposals and the role of patent GB/T
  • Definition of GB's IPR and handling
  • Standards adoption and application scope (industry/local standardization?)

USITO understands that SAC intends to promulgate the Measures and related GB/T standards before year-end.
