Fair Competition Review System to be Implemented

On October 26, the National Development and Reform Commission (NDRC) announced the Notice on Issuing the Fair Competition Review System Implementing Regulations (Interim) which were released by the NDRC, Ministry of Finance (MOF), Ministry of Commerce (MOFCOM), State Administration of Industry and Commerce (SAIC) and the State Council Legislative Affairs Office (SCLAO) on October 23, 2017. 
 
The main objectives and components of the fair competition review system were first laid out in the Opinions on Establishing A Fair Competition Review System in the Construction of Market System released by the State Council on June 14, 2016.  According to the Opinions, the goal of fair competition review system is to "prevent the issuing of policies and measures that obstruct or restrict competition". The implementing regulations are also drafted in accordance with the Anti-Monopoly Law and state that policies and measures should not result in monopolistic behaviors as outlined in the AML.
